Patent Law Basics with George Kobler

September 29, 2015 by Sheree Martin

George Kobler, Huntsville attorney, is the guest on episode 16 of the Ignite Alabama podcast

George Kobler, an attorney in Huntsville, Alabama whose practices in the area of intellectual property, is the guest on episode 16 of the Ignite Alabama podcast.

IP law encompasses patents, which is the focus of today’s conversation, as well as copyright law, trademarks, and proprietary information that falls within the realm of trade secrets.

In this conversation George explains the difference between copyrights, trademarks, patents and other forms of intellectual property. Our focus is on patent law.

Since the focus is on law and George and I are both members of the Alabama State Bar I wanted to give you the standard disclaimer that lawyers are required to use in advertising and other marketing materials, just to make sure that George and I are both in compliance with rules of the Alabama State Bar.

No representation is made that the quality of legal services to be performed is greater than the quality of legal services performed by other lawyers.

IP law encompasses patents, which is the focus of today’s conversation

This podcast is intended to provide general information only and shall not create or constitute an attorney-client relationship between the speaker and any listener.

To determine whether something might be eligible for patent protection, the first question is whether it pertains to eligible subject matter.

If the invention, discovery or process is within the scope of eligible subject matter, the next question is whether the invention or discovery is both novel and non-obvious.

I pose several hypothetical examples for George to use in his overview, including one from the realm of digital technology and one involving the mechanical adaptation of a lawn mower.

We also cover situations involving co-inventors, modifications to someone else’s design, inventions and discoveries made in the course of employment or using employer’s resources outside of the scope of employment.

We finish up the question with hypotheticals relating to the team and project-based environment common today, where independent contractors come together to work on one business idea, while remaining free to pursue outside ventures.

I’m giving you these takeaways in list format, and not necessarily in order.

Since there was a lot of back-and-forth and echoing of the tips, I decided to credit these to the panel, than the specific investor offering the tip.

14 tips from the VC panels at Investor Day Huntsville hosted by Rocket Hatch - focus of episode 15 of the Ignite Alabama podcast

Tip 1: Know something about the person you’re pitching to. Show them you’ve done your homework.

Tip 2: Before making a cold call, do your research. Look at the VC portfolio of companies. Is your product or service a good fit for their portfolio?

Tip 3: Use LinkedIn to do your homework and see if you have a common connection. If you do, perhaps use that common connection to learn something about the investor that reveal what the investor cares about most.

Tip 4: It can help to have someone introduce you, so if you have a common contact, take advantage of that.

Tip 5: Research the investor’s background. Find out if they’re from finance, accounting, marketing, sales. That will give you an idea about how to frame the pitch so it resonates with that mindset.

Tip 6: Venture capitalists and angel investors are in the relationship business. It’s important for you to develop relationships.

Tip 7: The character of your team matters a lot to the investor and this ties back to the relationships.

Tip 8: Investors are looking for an entrepreneur who is coachable. It’s OK if you don’t know everything. The VC has probably been in your shoes and knows what you don’t know, so be open to receiving guidance.

Tip 9: Some angel investors and VC funds like particular combinations of management teams.

  • For example, The Lamp Post Group likes 3-founder companies. Others may have a different preference. So try to identify this before hand, to maximize your opportunities and pitch to the right investor.

Tip 10: Know your numbers on your product and your market.

Tip 11: Tell a good story.

Tip 12: Practice your pitch. Practice it over and over. Get feedback and practice some more.

Tip 13: When you’re updating your investors, give them 1-2-3 specific things they can do to help you move forward.

  • For example, you might ask them to make an introduction to a specific person who could be valuable in getting a big account or landing a contract opportunity.

Tip 14: Heads-up for the women entrepreneurs. Many of the panelists, if not all of them, expressed an interest in hearing from women entrepreneurs and a desire to invest in women-led startups. So there’s an interest on the VC and Angel investor side to working with women. But we need more nurturing on the ecosystem side.

I also put together this Storify recap of tweets from the Investor Day Huntsville event:

Rocket Hatch Investor Day

The Rocket Hatch Investor Day is set for Thursday, September 10, 2015. The Investor Day event will bring together investors and entrepreneurs from across the Southeast to share experiences related to investing, pitching, launching and growing high tech startups.

The event will include panels on startup investing and pitching and will conclude with an open networking event at Sip+Hatch. Details here.

Antonio talks about the upcoming Investor Day in this podcast.

Rocket Hatch Community Values

The RocketHatch statement of values are a perfect reflection of what every true 21st century enterprise should cherish. Here’s an example:

  • Collaboration over competition
  • Trust over agendas
  • Encouragement over criticism

Those values reflect what I’m trying to offer through this podcast and my larger Shinecast mission. This podcast features conversations with entrepreneurs and innovators without no agenda other than sparking innovation and entrepreneurship in Alabama–in whatever form or shape it emerges–and perhaps helping me to grow my own entrepreneurial ventures.

Most people know Huntsville for its role in the NASA space program and for the many companies, large and small, that play a role in the national defense of our great country.

But Huntsville is also an arts community and it’s much more than a city for defense department contractors.

Before meeting with Antonio last week when he was in Birmingham for the Alabama Launchpad Innovation awards event, I spent some time reviewing the first annual report of the RocketHatch and I found it so refreshing.

I’ll just let the conversation with Antonio unfold and tell you the rest of the story.

I look forward to visiting with lots of Rocket Hatch community members on September 10, 2015 at the Investor Day event at the Space and Rocket Center.

Be sure to sign-up for the Ignite Alabama free email newsletter so you don’t miss an episode or news about Alabama’s entrepreneurial scene.

Consider this the introductory episode to 3D printing technology, also known as additive manufacturing. Dr. Sloan’s area of expertise is in computer science for 3D modeling.

The 3D Print lab at UAB is mainly used for teaching and research but contract 3D printing can be performed on a limited scale for anyone who has the CAD model program written for a project.

In terms of materials, the UAB 3D Print Lab can print in both ABS and PLA thermoplastics. ABS is a very sturdy plastic, while PLA is a non-toxic biodegradable plastic that’s suitable for medical type implants. Dr. Sloan gets into the difference briefly in his comments.

I first learned about 3D printing or additive manufacturing when I was a contributing writer for Fabricating Equipment News way back at the dawn of the 21st century. I was writing on rapid prototyping and innovations in fabrication and machining and was constantly interviewing researchers and engineers who were working on the cutting edge of that technology in the time between 1999 and 2002 so it’s exciting to see how the technology is advancing along with our growth computer processing capacity and understanding of materials science.

In this interview, Dr. Sloan talks about how the rapid advancement of computing capacity has made 3D printing possible. He provides some insights into the viability of 3D printing for custom manufacturing and the challenges of 3D printing for traditional mass production of inexpensive items.

Dr. Kenneth Sloan UAB Department of Computer Science

Dr. Sloan provides several examples of how dentists are using 3D printed implants and other items in today’s dental practice.

We also get into the subject of how students can prepare for careers that will involve 3D modeling and new approaches to machining, fabrication in manufacturing.

One of my goals for Ignite Alabama, as a podcast and a movement, is to help raise awareness of the many new technologies that are now available to entrepreneurs and to help everyone from business advisers to policymakers to investors to educators generate ideas to move our economy forward.

I’m working now to line up interviewers with other researchers, scientists and engineers who look at 3D printing from other angles such as biotech applications for burn treatment and materials research for industrial applications of 3D printing, such as in development by Rolls Royce using titanium to print a component for one of its jet engines. That part is already being tested.
